If the overhanging tree is not causing damage to your property but you want it trimmed anyhow, you can have it trimmed as long as it will not damage or kill the tree. Your neighbour is not responsible for the costs of this; however, it is recommended to speak with your neighbour before moving forward to avoid unnecessary conflict.
If the tree is right on the property line, that means you and your neighbour share the tree and are both responsible to keep it maintained and will both be responsible for management if it becomes hazardous.
